P ART 3 30 M ISCELLANEOUS AND G ENERAL Computer system 112 Automated computer system (1) The Keeper may, by means of an automated computer system under the Keeper’s management and control, carry out the duties imposed on the Keeper under Chapter 2 35 of Part 1 and Chapter 2 of Part 2. (2) The power under subsection (1) includes, for example, the power to enable— (a) the electronic generation and communication of applications under this Act, 65 Moveable Transactions (Scotland) Bill Part 3—Miscellaneous and General (b) automated registration under this Act, and (c) the creation of electronic documents. (3) The Keeper may impose reasonable conditions for using any computer system provided for the purposes of subsection (1). 5 Registration of electronic documents 112A Competence of registration of electronic documents Section 9G(1)(d) of the Requirements of Writing (Scotland) Act 1995 (registration and recording of electronic documents) does not apply in relation to the registration of a document by the Keeper under this Act. 10 Good faith 1 113 Good faith (1) This section applies in relation to any provision made in this Act as respects good faith. (2) If there is a dispute as to whether a person was in (or acted in) good faith, the burden of proof lies on whoever asserts that the person was not in (or did not act in) good 15 faith.
