The committee therefore agreed to ask whether the guidance has been amended and distributed to local authorities. The Standards Commission for Scotland's response is:"The Standards Commission has revised its guidance relating—amongst other matters—to planning applications and this was issued to all local authorities on 30 July 2004."

I give the assurance that that will be done.We have produced about 500,000 leaflets that highlight the facility, which are distributed across 5,000 venues in Scotland. However, more needs to be done to target mother and toddler groups, for example.

Tenements (Scotland) Act 2004 (Commencement No 1) Order 2004 (SSI 2004/487) The legal advice suggests that we draw the order to the Parliament's attention on the ground that it was made in the form of a statutory instrument when, arguably, the enabling act did not authorise that at the time.
