I know that there must be consultation about the codes, but will the codes be available to the committee—even in draft form—when we reach stage 2?

The act is fairly straightforward, but it leaves an enormous amount of detail to the code, so the Executive agreed to consult on a draft code, which was then amended considerably after consultation.However, an interesting point is that the Parliament could not amend the code at the final stage other than by rejecting the whole caboodle— Was the Parliament unable to debate the final version of the code?

In that case, there might be a graded policy that provides for the date of issue to be the relevant date, but there ought to be a presumption that the date of receipt is the relevant date unless there is a justifiable reason for treating some circumstances differently.

I have been involved in several tram and linear transport schemes in relation to which people have been concerned about construction disturbance, and the main reassurance that we were able to give them was the code of construction practice. The code gets more and more onerous as projects progress and the current code is no exception.
