S6M-01866: Maggie Chapman: The Right to Access Environmental Justice - That the Parliament notes the publication of the Environmental Rights Centre for Scotland report, Why Scotland needs an environmental court or tribunal, in October 2021; considers that the report informs the debate on how to ensure that members of the public, including those in the North East Scotland region, can enjoy their right of access to environmental justice, which it understands forms part of the procedural right to a healthy environment guaranteed by the Aarhus Convention, and is proposed for inclusion in a new statutory right in Scotland; believes that access to environmental justice is unaffordable to many, and that this is contrary to the requirements of the Aarhus Convention; welcomes what it sees as the Scottish Government’s commitment to ensure that a review of environmental justice, including the case for an environmental court, will commence by spring 2023, and notes the calls for all stakeholders to participate in this debate ahead of the 2023 consultation.

The 2040 target aligns with the energy performance certificate targets that are in “Energy Efficient Scotland: route map”, and it lends itself to the achievement of the interim target in the Climate Change (Emissions Reduction Targets) (Scotland) Bill that by 2040 Scotland’s net emissions must be at least 78 per cent lower than the baseline.

In response to the provisions of the Land Reform (Scotland) Act 2003 (the 2003 Act), all Local Authorities and National Park Authorities have a statutory duty to uphold access rights and as such ensure that access provisions are barrier free to enable all types of responsible access use, be that walking, wheeling a pram, buggy or wheelchair, scootering, cycling or riding a horse in places where access rights apply.

If they find that people’s rights are not being respected the MWC currently have a duty to provide advice to the relevant health board and to alert relevant bodies, including Scottish Ministers and Healthcare Improvement Scotland.
