The Ethical Standards Commissioner regulates this area and their Code of Practice for Public Appointments (the ‘Code’) and associated Code Guidance (both 2022) set out the position relating to political activity.

Scottish Government are currently working with COSLA and SOLACE to complete the review of the Code Of Practice. A consultation on proposed changes is planned for the autumn.
To ask the Scottish Government when it plans to publish a new edition of the Scottish Ministerial Code. A new edition of the Scottish Ministerial Code was published on 20 July 2023 and is available here: https://www.gov.scot/isbn/9781835210567 .

Read the responses to proposed changes to Section 6 of the Code of Conduct in relation to the establishment and operation of Cross-Party Groups.
It issues guidance to councils and public bodies, and adjudicates on alleged contraventions of the codes referred to it by the Commissioner for Ethical Standards in Public Life in Scotland.
NHS Lanarkshire (Code Black) I listened to the First Minister’s reply to Anas Sarwar and I have to be blunt: people in Lanarkshire are very afraid of becoming sick.
I know that it is perfectly possible to adequately and robustly scrutinise an organisation without falling foul of the code. We expect people to scrutinise and to stay within the code.
