Female Genital Mutilation (Protection and Guidance) (Scotland) Bill - Offence of failure to protect from FGM
Noting the social context in which risk of FGM may exist, we are also concerned about a number of adverse consequences in relation to potentially criminalising individuals who do not have the agency to protect girls (as opposed to being held accountable for a proactive course of conduct) and potentially reinforcing the hidden nature of the practice.
