The instrument makes amendments to advice and assistance regulations to support a sheriff court initiative that seeks to encourage appropriate early resolution of summary criminal cases.
The Scottish and UK Governments’ view is that it is either a Special Non-Contributory Benefits (SNCB) or social assistance. If Best Start Grant is determined by the Administrative Commission to be social assistance it will fall outside the provisions of social security co-ordination in the Withdrawal Agreement.

The Bill makes it clear that the provisions on third party funding would not apply to assistance through legal aid.
In addition, it is not the Scottish Government's policy intention that section 10's provisions should apply to other forms of funding, such as trade unions or insurance providers.
