ESS has the authority to issue an Improvement Report if it considers a public authority has failed to comply with environmental law and to make recommendations to ensure compliance. When they lay an Improvement Report, the Scottish Ministers then have six months (or nine months if they wish to undertake consultation) to prepare an Improvement Plan and lay it before the Scottish Parliament.
