This regulation provides: “For the purposes of Article 19(1), any transponder implanted into an equine animal by a veterinary surgeon must display a code unique to that transponder.” Regulation 17(h) provides that failure to comply with this requirement is a criminal offence.

The Committee considers that the sanctions it recommends reflect the seriousness of the breaches of Sections 7.3 and 7.4 of the Code in this case. Had it not been for mitigatory factors, including the impact on the member and his family, the sanctions proposed would likely have been greater.
