As a matter of process, however, the instrument was made on 26 May and laid on 28 May, creating a two-day gap between the making of the instrument and the laying of it. The Scottish Government has accepted that, in relation to the 28-day rule, which has of course been breached, it would have been an advantage if arrangements had been put in place to lay the instrument forthwith after it was made on 26 May, rather than two days later.
