I also understand that Forest Enterprise has a stricter code of access than other landlords. I was told today that the Scottish Crofters Union has still not signed up to "The Comeback Code" because of open grazing in the Highlands and other concerns.

A person must not fail to"take such steps as are reasonable"and an animal's needs must be"met to the extent required by good practice",which, I have no doubt, depends on the codes that will emerge. Offences include acts that are undertaken without reasonable excuse.

The matter relates less to the bill than it does to implementation of the Land Reform (Scotland) Act 2003, which contains the access legislation and the code. Implementation of the code is a matter for Scottish Natural Heritage and the local authorities through the local access forums.
