SP Bill 11B Session 5 (2018) 2 Forestry and Land Management (Scotland) Bill Part 2—Forestry functions Chapter 1—General forestry functions Forestry strategy 3 Duty to prepare forestry strategy (1) The Scottish Ministers must prepare a forestry strategy. (2) The forestry strategy— 5 (za) must set out a vision for forestry in Scotland, (a) must set out the Scottish Ministers’ objectives, priorities and policies with respect to the promotion of sustainable forest management, and (b) may set out other matters with respect to the promotion of sustainable forest management. 10 (3) The forestry strategy must include the Scottish Ministers’ objectives, priorities and policies with respect to— (za) the creation of woodland, (a) the economic development of forestry, (aa) targets for the planting of trees, 15 (b) the conservation and enhancement of the environment by means of sustainable forest management, (c) the realisation of the social benefits of forestry, (d) the acquisition and disposal of land under sections 15 to 17, (e) the production and supply of timber and other forest products. 20 (4) The Scottish Ministers— (a) must keep the forestry strategy under review, and (b) may, if they consider it appropriate to do so, revise the strategy. (5) If the Scottish Ministers have not revised the forestry strategy under subsection (4)(b) within the period of 9 years beginning with the day on which the strategy was last 25 published, they must revise the strategy. 4 Preparation and revision of forestry strategy (1) In preparing or revising the forestry strategy, the Scottish Ministers must— (a) publish a draft of the strategy and consult with such bodies as they consider appropriate and also with the general public, 30 (b) have regard to— (i) the land use strategy (prepared under section 57 of the Climate Change (Scotland) Act 2009), and (ii) the land rights and responsibilities statement (prepared under section 1 of the Land Reform (Scotland) Act 2016), 35 (iii) Article 2 of the Kyoto Protocol to the United Nations Framework Convention on Climate Change, (iv) the code of practice on deer management (drawn up under section 5A of the Deer (Scotland) Act 1996), Forestry and Land Management (Scotland) Bill 3 Part 2—Forestry functions Chapter 1—General forestry functions (v) the Scottish Biodiversity Strategy (prepared under section 2 of the Nature Conservation (Scotland) Act 2004). (2) The forestry strategy must be prepared and revised with a view to achieving consistency, so far as practicable, between the objectives, priorities and policies set out in the strategy 5 and the Scottish Ministers’ other functions. 5 Publication of forestry strategy (1) The Scottish Ministers must publish the forestry strategy and each revision of it. Changes to safe access zones 30 7 Extension of safe access zones (1) If an operator of protected premises considers that the condition mentioned in subsection (4) is met, the operator may apply to the Scottish Ministers for an extension of the distance between the boundary of the protected site and the boundary of the safe access zone to an extent that the operator considers appropriate. 35 (2) The Scottish Ministers may approve an application made under subsection (1) if they are satisfied that it is appropriate to do so. (3) If the Scottish Ministers consider that the condition mentioned in subsection (4) is met, they may of their own accord extend the distance between the boundary of the protected site and the boundary of the safe access zone to an extent that they consider appropriate. 40 (4) The condition referred to in subsections (1) and (3) is that the safe access zone does not adequately protect persons who are accessing, providing or facilitating the provision 5 Abortion Services (Safe Access Zones) (Scotland) Bill of abortion services at the related protected premises from any act of a type mentioned in section 4(1) or 5(1). (5) Where the Scottish Ministers extend a safe access zone for protected premises under subsection (2) or (3), they may, for one or more other protected premises, extend the 5 distance between the boundary of the protected site and the boundary of the safe access zone (to an extent that they consider appropriate) if they consider it appropriate to do so. (6) The Scottish Ministers may extend the distance mentioned in subsection (5) in relation to other protected premises by a different extent for different premises. 10 (6A) Before extending a safe access zone under subsection (2), the Scottish Ministers must 1 consult such persons as they consider appropriate. (6B) Before extending a safe access zone under subsection (3) or (5), the Scottish Ministers must consult— (a) either— 15 (i) the operator of the protected premises, or (ii) such persons as they consider representative of the interests of operators, and (b) such other persons as they consider appropriate. (7) Where the Scottish Ministers extend a safe access zone under subsection (2), (3) or (5), 20 they must update the list maintained under section 2(3)(b). (1A) Before reducing a safe access zone under subsection (1), the Scottish Ministers must 30 consult— (a) either— (i) the operator of the protected premises, or (ii) such persons as they consider representative of the interests of operators, and 35 (b) such other persons as they consider appropriate.
