The Permanent Secretary may provide Ministers with advice on matters which the Code covers and will ensure procedures are in place to support compliance with the Code.
The power is required to oblige the Scottish Ministers to prepare and lay a draft code of practice before the Parliament and to publish the code when the regulations are made.
Section 26 provides the code must be reviewed at least every five years and that the Scottish Ministers must consult before publishing a code or revised code.
