The debate in the Justice 2 Committee alluded to some guidance, but the guidance, although it is good, is a voluntary code rather than a compulsory one. More could be done in the bill to make good conduct compulsory.

That procedure is recognised in the draft code of practice on ministerial appointments to public bodies in Scotland, which is due to come into force in April.The draft code also proposes that the existing 10-year limit on the tenure of appointments should be removed.
