It is normal practice for those who are appointed as sheriffs to be sent to a different part of Scotland. Under the shrieval code of conduct, a sheriff should not sit in a case of the sort that is detailed in the petition.

The Executive is in danger of putting into the instrument a provision that should be common sense, or in a code of practice, not binding. We can at least lay down markers and flag up the issue, even if we can do little beyond that.

As Cathy Peattie knows, at yesterday's Education, Culture and Sport Committee, when it discussed the Standards in Scotland's Schools etc Bill, the Executive agreed to introduce an amendment at stage 3 to provide for a code of practice in relation to the inspection of schools.
