It would have captured many of those in the greatest poverty, for whom making any level of contribution to legal costs would be one extra cost too far. Am I right in understanding that the Scotland Act 1998 says that, if we were to do something that would impose extra costs on the Treasury, we would have to refund that money to the Treasury and that, therefore, logically, if we do something that benefits the Treasury, it should refund us?
