I missed out an important point that I might have mentioned had Mr McKie asked me further about the details of the code. In finalising the code of construction practice, the contractor will be required to prepare his or her own code, which fully complies with the code that we have set up to date.

I do not believe that there has been a breach of the code of conduct in this instance. However, it is at least arguable that the actions described do not accord with the spirit of the code.
