One reason that we are moving forward jointly with DEFRA is to ensure that we get the benefit of its research and expertise when drawing up our code of practice. It is useful to get on the record when the voluntary code of practice will be available.
Whether the code is a separate code or a revision to the existing code that applies in England and Wales, it will be subject to approval by the Westminster Parliament.
It wishes that the protocol was more closely aligned with that carefully negotiated code. The key difference between the code of confidentiality and the protocol is that, under the code, all patients have an opt out.
The committee will be aware from the working draft of the code of practice on records management, which will be required under section 61, that the code will offer guidance on keeping, managing and destroying records.
