The Committee noted that the Minister for Parliamentary Business, had written to the relevant UK Government Minister on 30 May 2025 in relation to the timetabling of the Bill and to “stress [his] concern over the limited time now available for the Scottish Parliament to give its consent and also that [he] will now be obliged to ask it to do so to an expedited timetable” in order for the Parliament consent decision to be given before the summer recess...
However, the Committee considers it important that the Scottish Government has further dialogue with the Federation of Small Businesses Scotland before the end of Parliament’s summer recess, to seek to address the Federation's concerns, and to set out the outcome of this dialogue in its response to this report.
Under section 28(2) of the Interpretation and Legislative Reform (Scotland) Act 2010, instruments subject to the negative procedure must be laid at least 28 days before they come into force, not counting recess periods of more than 4 days. The instrument breaches this requirement as it was laid on 26 March 2024 and came into force on 7 May 2024.
Under this procedure the regulations would cease to be in force after 28 days (longer if Parliament is in recess) unless agreed by Parliament. Should Parliament not agree to the regulations, Ministers would not be prevented from making further regulations.
The Committee asks for a response, and for the opportunity to take evidence on this issue after our summer recess, prior to any decision being taken in relation to this matter.
