We are in a slightly different place on the education side as we have a legislative framework in place, with the Education (Additional Support for Learning) (Scotland) Act 2004, as updated by the Education (Additional Support for Learning) (Scotland) Act 2009, which commenced three days ago. We have a statutory code of practice in place. Under the code of practice and the legislation, there is a focus on the needs of individual children.On a policy level, under both the previous Administration’s 2004 act and the present Administration’s 2009 act, we are clear about not listing specific groups.
