We were unhappy about being asked to agree to the instrument without sight of the code of conduct. In the end, the motion to approve the instrument was not moved and the instrument was relaid, along with the draft code a short while later.

The 1937 act covers public records in general, but the issue around the current voluntary code comes under the 1994 act. Had that been successful, we would not have had the result of the Shaw report or, indeed, the Kerelaw inquiry.

My experience of chairing a number of public appointments panels involving OCPAS representatives is that the code is very much adhered to and the necessary transparency and openness is in place.
