Twenty years ago, the Lord Advocate decided not to prosecute children under the age of 13, following the case of Mary Cairns in Glasgow, which had an effect on the prosecution of very young children.Children under 13 can be prosecuted in the High Court or before the sheriff under, I think, section 413 of the Criminal Justice (Scotland) Act 1970.

However, I feel that Roseanna Cunningham and Mary Scanlon had a point when they said that there is a requirement in section 1(2) that interventions must benefit the person with incapacity, but that there is no corresponding requirement that a decision not to intervene must benefit them.
