Our information is that a policy on what happens to medical records now applies. A code of practice on NHS records management, which was issued in July 2008, covers the retention and disposal of patient records and was agreed with the National Archives of Scotland.

In terms of my own powers, enforcement could be provided only through a revision of the code of practice. As I said, I do not have authority to insist that certain actions are taken, but I can take action when the code of practice is not complied with in a material regard.
