It is my understanding that if we were to accept amendment 152, it may become possible for a former superior to have a double claim in respect of the development value of land. The intention behind the subsection as introduced was to ensure that a superior should not be able to claim compensation by virtue of the reserved right if, for example, the reserved development value could be recovered by virtue of a contractual claim.
