Section 73A also requires the Scottish Ministers, before issuing or revising such guidance, to consult such persons as they consider appropriate, and to lay a copy of the guidance before the Scottish Parliament as soon as reasonably practicable after it is issued or revised.

If regulations are made that would transfer the function of providing a children’s service or a justice service, the Scottish Ministers must first consult publicly on the proposal. They must thereafter lay a summary of the consultation process before the Parliament when laying such regulations.
These sections require the Accountant of Court, where a judicial factor is a member of a professional body, to refer a judicial factor to their professional body in cases where the Accountant “is satisfied that there is, or has been, serious misconduct or material failure on the part of the judicial factor”.
Judicial factors have a right to apply to the court regarding any decision of the Accountant (s 45).
