Although the powers will be subject to the affirmative procedure, and therefore to scrutiny, it is still worth drawing to the attention of the lead committee the fact that we had concerns and that, although we are partly reassured by what the Executive says, we would still like the lead committee to be aware of those concerns. I have difficulty in understanding how, if it is the general law that specific powers to charge are necessary, you can say that because a power to charge is not included in section 4(1) the Executive has the power to charge. I do not follow that. I am saying that, underneath that broad power, there are examples, which include a provision about charging.

We should ask the Executive for a general opinion on public appointments following the new legislation. I have no problem with the principle of that, but the allegations are specific and, as such, the Standards Commission should be the body to deal with them.

The only response that we have received from the Electoral Commission was to questions that were posed to its representatives at the previous meeting, but which they could not answer, and the only letter that we have sent following that evidence was on the number of MEPs that Scotland should have.
