The committee may consider that better advance planning of the regulations could have avoided the breach, taking into account that directive 2011/97/EU, which is implemented by the regulations, was published in the Official Journal of the European Union in December 2011 and provided until 15 March 2013 for implementation.The Scottish Government has explained to the committee that the timings of the implementation of the directive and the chosen date of laying the regulations in advance of the date when they came into force have been considered to be an example of appropriate prioritisation of legislation.
