Executive Summary
This is the seventeenth in a series of SPICe briefings covering the negotiations on the future relationship between the EU and the UK.
As the Justice Committee's call for views on the Bill closed on 4 December 2020, it has not been possible to incorporate a discussion of the written submissions to the Committee into this SPICe Briefing.
The briefing also describes consultation proposals from 2018 that did not make it in to the Bill.
Briefings on the Regulations and SBR were prepared by the Financial Scrutiny Unit in SPICe and the Scottish Government.
The Delegated Powers and Law Reform Committee considered the Regulations at its meeting on 6 October 2020 and determined that it did not need to draw the attention of the Parliament to the instrument.
Issues around ring-fencing and the extent to which elements of the budget are “protected” will be explored in more detail in the forthcoming SPICe briefing on the local government budget and allocations to local authorities.
