As such we are laying this draft instrument as well as a statement explaining why the Ministers consider it appropriate to lay the regulations under section 97(9)(b) of the Act without a report from SCoSS having been prepared.
The instrument will also dissolve NHS Health Scotland and make a number of consequential amendments to account for the transfer of functions and activities to public health Scotland from NHS Health Scotland and NHS National Services Scotland.
Where an instrument is laid in draft but a drafting error has been identified, the Committee has to date tended to recommend that the instrument should be withdrawn and re-laid with the error corrected. If there is no time for re-laying, then there is the option of laying an amending instrument.
