I am writing to advise you that the final report is to be published on the SMHLR website on Friday 30 September; https://mentalhealthlawreview.scot/ This Government wants to ensure that Scotland’s legislative framework continues to lead the world and the work of the Review therefore plays a key role in laying the foundations for future reforms.
The Committee’s report also highlighted that in its covering letter to the instrument, the Lord President’s Private Office had apologised for the short laying time, explaining this was— “necessary to respond urgently to the Scottish Government’s announcement that it intends to commence the relevant provisions of the 2019 Act on 17 December 2021.”
As drafted, the bill’s oversight mechanism is the requirement to lay all national plans in the Scottish Parliament and to lay a progress report every five years.

The Committee suggests using an existing provision, Section 97 of the Climate Change (Scotland) Act 2009, for a “pre-laying procedure” – presenting Parliament with regulations in draft form alongside a statement of reasoning, for a period of at least 90 days before the regulations themselves are laid.
This will help the Scottish Government achieve its aim of reducing the impact of single-use plastic products on the Scottish environment. Intended laying date (if known) of instruments likely to arise 8 June 2022.
States Parties undertake to promote and encourage international co-operation with a view to achieving progressively the full realization of the right recognized in the present article. In this regard, particular account shall be taken of the needs of developing countries.
