It was the unanimous view of the committee that greater consistency in practice and behaviour among people who provide land-agency services—whether they act on behalf of landlords or agents, and irrespective of whether or not they hold membership of the RICS—is desirable; that the code must have teeth; and that the Scottish Government should monitor development of the code to ensure that it is fit for purpose.

Under the Regulation of Investigatory Powers (Scotland) Act 2000, which was passed during the Liberal Democrat and Labour Administration, the Parliament put in place the covert human intelligence sources code of practice. The code states: “Any Police Scotland Officer deployed as a ‘relevant source’” —the term used for undercover officers— “in Scotland will be required to comply with and uphold the principles and standards of professional behaviour set out in Police Scotland’s Code of Ethics.”

I am aware of the issues with the previous CPG on autism; as you have said, the rules have changed, but it is also the case that some CPGs have a code of conduct for their operation, and I think that that might be an opportunity that we could consider.

It strikes me that adherence to the muirburn code and restrictions on the use of medicated grit and mountain hare culls could form part of a licensing regime, but that would be for the stakeholder group to take forward—if the committee supported option 2 and the Government chose to take it forward.
