It is intended to ensure that there is as smooth a transition as possible back to pre-pandemic time limits by avoiding a situation where a large number of cases all reach their time limit at the end of 30 November 2025.
The number of people seen within six weeks for diagnostic tests and screening fell markedly in March 2020 (see figure 8), and is still below pre-pandemic levels. Screening uptake was lower pre-pandemic in the most deprived areas.
Subsection (3) deals with any references in the pre-action requirements which need to be updated in order for that document to be read as being the pre-action protocol which is provided for under the Bill.
If section 2 were to be amended to exclude functions in UK legislation from its scope, it would significantly reduce the reach and effect of the Bill (as the Scottish Ministers’ functions under pre-devolution UK enactments would not be subject to the section 2 duty to exercise them compatibility with the Charter).
