The convention does not favour generalised immunities, privileges and exclusions—it deals with the facts and circumstances of each case and whether the test of proportionality has been met. Many conventions—written or unwritten—will have to be revisited.
Also, as Irene said, some of the information produced by on-going academic studies would be useful to us. I am sure that many academic studies have collated such information.
Therefore, if it was considered that such a scheme was so generous as to create perverse incentives, I would hope that many commentators would point that out.
