I would be unhappy about being placed in a position whereby we recommend positively to the Parliament that the orders be approved. At the end of the day, it may well be that the orders should be approved, but I want to be satisfied that that is the correct course of action.

In the letter to the Executive, we could ask whether it thinks that the fact that people in Scotland do not have a third-party right of appeal in planning decisions is consistent with the ECHR. That may help with any approach to the European Parliament.
