There is a proposal for that to be three years, with that period running from start of the criminal investigation rather than from the date of the offence. What is the Law Society’s view on that?
The petition, which was lodged by Derek James Brown, calls on the Scottish Parliament to urge the Scottish Government to require council tax discounts to be backdated to the date when a person was certified as being severely mentally impaired, where they then go on to qualify for a relevant benefit.
It is about preventing fraud from occurring and, as I said, it is about preventing people from making mistakes and about forcing people to think about data that they have submitted and whether it is up to date and accurate or needs to be changed.
Occasionally, if people are moving house, flat-sharing or moving around, their address might not be up to date. However, for the larger proportion of people—90-plus per cent—we are confident of having up-to-date address information.
It would be useful—essential, in fact—for the committee to have as up to date a position as possible on the petition, which we have identified as important.
But why is the figure only £6.7 million on 1 April in the year 2021-22, and more than £66 million on the same date a year later, when the net funds appear to be pretty similar?
