We will review that again in two weeks—before the Easter recess—and our expectation now is that that regulation will convert to guidance in early April.
Section 28(2) of the Interpretation and Legislative Reform (Scotland) Act 2010 requires that negative instruments are laid at least 28 days before they come into force, not counting recess periods of more than 4 days. As this instrument was laid on 23 February 2021 and comes into force immediately before 4 March 2021, it has therefore breached this rule.
Instead, Boundaries Scotland will have 12 years from the date of completion of each review within a local government area to undertake the next review in relation to that area.
Having them come into force on a date appointed by regulations means that the Government can appoint a date having ensured that everyone who needs to prepare for the new duties has had the necessary time to do so, within the 2 year limit.
