Letter to Committee Conveners REUL

A resolution would be required on or before 31 October 2023, to allow the regulations to be made by that date. Under Standing Orders, lead committees have 40 non-recess days to consider and report on draft affirmative instruments, although the Parliament may suspend Standing Orders for particular cases.

Coronavirus (Discretionary Compensation for Self-isolation (Scotland) Bill

The Delegated Powers Memorandum for the Bill states that as the pandemic situation is constantly evolving, it may not be possible for Scottish Ministers to reach a view on whether the expiry date should be extended sufficiently in advance of the expiry date to allow time for regulations to be progressed through the affirmative procedure, particularly if the Parliament is in recess.

This is in line with the recommendation in the Budget Process Review Group Final Report that the Medium-Term Financial Strategy is published following the UK Budget and at least four weeks prior to summer recess. We have separately advised the Scottish Fiscal Commission of the publication date, in line with the protocol agreed between the two bodies which requires that the Scottish Government gives the Commission at least 11 weeks’ notice of the expected publication date.
