Is the instrument therefore likely to come before this committee or the Health and Community Care Committee before the summer recess? It would be reasonable to speculate that such an instrument will appear.
Members will recall that the First Minister was asked about that in the final week before the recess. He was asked specifically whether the legal advice would be published and he said, "Maybe".
The education bill is likely to be introduced in January, but we do not know the particular date. We do not have dates for the transport bill or the housing bill either.
We must make our decisions today, because the first evidence session is on our first day back after the Christmas recess. We must get notice out to the witnesses prior to the recess.
As yet, we are not in a position to make a public announcement on that subject, although, in response to Phil Gallie in a debate before the summer recess, I made it clear that I would try to make a statement after the recess.
Are any of the dates during recess? One of them is, but I suggest that the latest date, 22 February 2002, is most suitable because, realistically, we need to leave ourselves enough time.
The final point is on regulation 2(b), in which references are made to the "specified date". We need to know to which date the first "specified date" refers.
