Under the Custodial Sentences and Weapons (Scotland) Act 2007 – Where a removed offender re-enters the United Kingdom at any time before the date on which they would have completed their full sentence, the person is liable to be detained in pursuance of the person’s sentence until the earlier of the following:
a) the date of the expiry of the outstanding custodial period,
b) the date on which the person would have served the person's sentence in full (but for the person's removal from prison under section 9B).
Committee consideration
The Scottish Government explains that this power is required to ensure that the list of relevant offences can be kept up to date. This requires a degree of flexibility.

The Committee highlights the correspondence between the Committee and the Minister for Parliamentary Business dated 6 October 2021 Letter from Convener to Minister of Parliamentary Business dated 6 October 2021 and 21 October 2021Letter from the Minister of Parliamentary Business to the Convener dated 21 October 2021, in relation to options for Parliamentary scrutiny of the exercise of such powers.
This is underpinned by the over-arching automatic enrolment regulations which apply on the ‘auto enrolment’ date.
In answer to question 4, SG agrees need for change and proposes to do this by a correction slip.
We now expect only a small number of frameworks to be completed by the end of the year, which was the original planned completion date. None of the frameworks that relate to the notifications that the committee is considering today will be completed by the end of the year.
