Early release on licence is known as home detention curfew (“HCD”)iiiHDC allows prisoners to serve the remainder of their custodial sentence in the community under licence conditions, earlier than their automatic early release date. Section 3AA(5)(e) expressly excludes prisoners who are liable to removal from the UK from this early release scheme.

Statutory requirement to lay the Regulations by 6 May 2023
Section 4(1) of the parent Act provides that the Scottish Ministers must lay the draft Regulations containing the Code before the end of the period of 2 years beginning with the date that section came into force. Accordingly, this should have been done by 6 May 2023.
