Conclusion
It is the Committee's view that members of the public have a right to expect that MSPs will normally respect their wishes with regard to confidentiality. At a later date, the Committee intends to reflect more fully on the provisions in the Code of Conduct relating to confidentiality.

Historical Sexual Offences (Pardons and Disregards) (Scotland) Bill - Disregards scheme
For a disregard to be accepted, the conduct amounting to the offence must not be an offence on the date the Bill is commenced. Any sexual offence that is currently illegal would not be disregarded, for example, offences relating to the absence of consent or sexual activity in a public place1Scottish Parliament.
