Section 8
This section would change the starting point of twenty year prescription in relation to the obligation to pay damages. It would make it begin on the date of the defender's last act or omission, as opposed to when the loss or damage actually occurred.
New claims can still be made for reduced earnings allowance, but only for accidents before 1 October 1990 or diseases contracted by that date. An existing reduced earnings allowance award can convert into an award of retirement allowance.
The 1976 Act is repealed by virtue of regulation 2 and it and the associated 1977 Rules only remain in force in relation to inquiries that were applied for before the date of commencement (regulation 4).
It is our intention to test out this advice note with local authorities, refine it and then incorporate it into the statutory SWF guidance at a later date.
