IT contractors were also critical of the procurement process suggesting that some tenders were “failing to keep pace with modern procurement processes”. Contractors pointed to out-of-date information being used which was not fit for purpose and text apparently being cut and paste from previous bids.
It further adds SNIB to the list of public authorities in the 2012 Regulations and modifies the 2012 Regulations in their application to SNIB so as to provide different dates by which certain duties have to be complied with.
The reasons for the breach of the 28 day rule in this case are set out in a letter to the Presiding Officer dated 16 June 2020.
The letter explains that the EU Commission reviewed UK measures that were due to come into force on 27 June and decided they were not justified in respect of two of the four identified pests.
The reasons for not complying are set out in a letter from the Scottish Government to the Presiding Officer dated 29 January 2020 (see Annex).
The Committee is content with the reasons given by the Scottish Government for bringing the Regulations into force so quickly.
The detail of policy will therefore be framed by subordinate legislation at a later date if and when the Bill is passed. The Delegated Powers and Law Reform Committee had observations on the scope of some of these powers, as discussed at relevant parts below.
