The Committee recognises that the majority view welcomes the power for courts to ‘strike down’ old incompatible legislation (legislation which pre-dates the Bill), or make a declaration that new legislation is incompatible with the UNCRC (legislation which post-dates the Bill).
Michel Barnier’s statement that the end of October was the “strict deadline” implied that the mid-October European Council would not be the final date for a deal, at least from the EU’s side.

Dear Convener,
I thank you for your letter about the Act of Adjournal (Criminal Procedure (Scotland) Act 1995 Amendment) (Miscellaneous) 2020.
It notes the comments that it is difficult to determine whether the penalties set out in the Bill are sufficient when only one prosecution has been achieved to date. It also accepts the view that for some victims, no sentence will be sufficient in terms of the violation of their human rights.
On that basis, the starting point for the Member has been that there should be no further convictions for Section 1 or Section 6 offences from the date on which the repeal of those offences takes effect.
