Following Simon Brown's evidence, the Scottish Solicitors Bar Association (SSBA) wrote to the Committee to provide clarification, based on past experience, as to how defendants were likely to present themselves in court if charged with an offence under the Bill:
As Mr Brown said in his evidence, we would feel it likely that there will not be an issue in proving to a court that protestors arrested under this legislation were there to protest.
