The parties to the FAI require to be given sufficient notice of the proposed date to enable them to make the necessary investigations and preparations.Once the suitability of a date has been established the Procurator Fiscal will make a formal application to the Sheriff Clerk for the FAI which will already have been provisionally programmed for a particular date.

They do so without being specific about how the request should be made—for example, it could be made in writing, by e-mail or by video—but the fact that we say that the request must be capable of being used for subsequent reference means that it is a matter of fact that the communication took place on a certain date. Therefore, as I said in my introduction, the clock starts ticking on that date and, in any review of a specific case, HMIE would be able to refer to that date as the date on which an authority asked an appropriate agency to comply with a request that had been made under section 23(1) of the act.
