This report covers the work of the Committee from 12 May 2020 to 24 March 2021, after which the Scottish Parliament goes into the campaign recess period from 25 March to 4 May 2021.
However, the current substantial programme of upcoming work for the Committee, combined with the reduced number of meetings available between now and summer recess means that the Committee’s immediate capacity is significantly reduced.
The letter explains that, although the need for such regulations became clear in the days following the escalation of violence on 13 June, there was not sufficient time to prepare them prior to recess beginning on 28 June and, as such, it was necessary to make them during recess.
Two days later—funnily enough, once we had all exited the building for the summer recess—and guess what? Delays were announced and—I give a spoiler alert to colleagues—the ship is still to be handed over to CalMac, and it is nearly October.
Also in relation to this instrument, there has been a failure to comply with section 28(2) of the Interpretation and Legislative Reform (Scotland) Act 2010, which requires that instruments subject to the negative procedure are laid at least 28 days before they come into force, not counting recess periods of more than four days.
