The area beyond the EEZ is known as the high seas and it is subject to freedom of fishing, meaning that all states have a right for vessels flying their flag to fish on the high seas, subject to their obligations to ensure the conservation and management of fish stocks.
8.1.3 Cooperation in the exchange of fishing opportunities
Alongside the management of shared stocks, the agreement also addresses the question of access to fish stocks within the jurisdiction of the other party.
This means that future fishing opportunities should be based on the principle of zonal attachment, which better reflects where the fish live, and is the basis for the EU’s fisheries agreement with Norway.
As a result, there are challenges to ensuring that collective fishing efforts are sustainable in the absence of agreement with all other fishing states.
This new agreement does not fundamentally alter the system for allocating fishing opportunities to EU vessels and the level of access is still determined through an additional protocol.
In determining these fishing possibilities, each Party shall take into account:
(i) the habitual catches of both Parties,
(ii) the need to minimise difficulties for both Parties in the case where fishing possibilities would be reduced,
(iii) all other relevant factors.
