On the conditions that would trigger a referendum the “precedent” of 2011-14 points to a pro-independence majority being returned to the Scottish Parliament and a consequent transfer of legislative competence from Westminster to the Scottish Parliament for the latter to legislate for a referendum.
We must ensure that there is a safe and secure transfer of the powers, because 1.4 million people rely on the benefits that are being devolved, and it is vital that the transfer ensures that everyone continues to get support.
We are also pleased to see Scottish Government’s commitments to make further improvements and consider widening eligibility to the benefit further once case transfer process is complete and post launch of Carer Support Payment in 2024.
The instrument updates the Fruit and Vegetables Aid Scheme (FVAS) ahead of the scheme closing in England and responsibility for delivering the scheme in Scotland transferring from the UK Government's Rural Payments Agency (RPA) to the Scottish Government's Rural Payments and Inspections Division.

Subsection (1) clarifies that it is the Secretary of State (and therefore, as a consequence of the transfer of competence, the Scottish Ministers) who is to make regulations under the Social Security Administration Act 1992, and subsection (4) makes further provision about how powers in that Act may be exercised.
