Under Scots law, victims and witnesses in cases involving serious crimes are given some protection from accused persons while such cases are awaited through the provisions in sections 24 and 26 of the Criminal Procedure (Scotland) Act 1995.

The committee's—or the Parliament's—legal powers to require witnesses or documents come under sections 23 to 26 of the Scotland Act 1998. The later sections are supplementary.
